Site rules (Terms of Service)

For Creators

1. You own your own material. Ourmedia claims no intellectual property rights over the material you provide to our service.

2. When publishing your work to Ourmedia, you may choose a copyright license detailing how others may use your work; you may donate your work to the public domain; or you may use traditional copyright. Regardless of which copyright choice you make, you recognize that others may access, view, copy, store or redistribute your work.

3. You must be at least 16 years old to upload material to this site without the supervision of a parent or teacher.

4. When offering material for this site, you must provide your real name and contact information. That information will not be displayed on the site (unless you choose to), but we need to know who contributed an item in case you change your mind and want to remove it, in case we need to contact you regarding missing descriptive data, or for similar reasons. We will not give your name or contact information to any outside party — ever — unless we are required to do so by law. See our Privacy Policy.

5. This is a public Web site intended for the dissemination of creative works. If you’re looking for a storage space for your private photos or video, Ourmedia is not for you.

6. We are not liable if someone uses your work in a way you don’t like. If that happens, you’re free to pursue legal remedies against such a third party, but you agree not to seek legal redress against us, our partners or affiliates.

7. By agreeing to place your material on our site, you recognize that it may also appear on search engines, in an open media registry, and on our present and future partners' sites, including the Internet Archive, a nonprofit Web repository, as well as commercial sites listed on our Partners page.

8. You affirm that you own the rights to the material you are placing on the Ourmedia site, have obtained the proper clearances to do so, or have the right to share it under well-accepted fair use standards.

9. You agree that the material you are publishing on Ourmedia does not violate copyright, trademark or patent laws, is not pornographic, plagiaristic or defamatory, is not hate speech or spam, and does not violate anyone's privacy rights. We reserve the right to remove material that we determine in our sole discretion violates these Site Rules. We also reserve the right to terminate the membership of anyone who violates these rules.

10. Ourmedia will not edit or alter your work. However, you agree to allow the Ourmedia community or its agents to add additional metadata tags to your file(s). Tags may also be removed if they offend the Ourmedia community or if they intentionally mislead readers.

11. If circumstances warrant, you may withdraw material from this site that you previously agreed to share, although we hope you won’t.

For Users

1. Each Contributor has chosen a license that spells out how others may view, use, sample or build upon their works. When accessing the material on this site, you agree to abide by the usage provisions specified by each copyright owner.

2. You agree to share, reuse, adapt, modify or build upon materials from this site only when the copyright owner has agreed.

3. You must be at least 13 years old to use this site without adult supervision.

4. When registering for this site to post comments or for other purposes, you must provide your real name and contact information during the registration process. You may not share your log-in or password with anyone else.

5. You must not abuse, harass, threaten or intimidate other Ourmedia Users. You must not modify, adapt or hack Ourmedia.org or modify another website so as to falsely imply that is is associated with Ourmedia.org. Violation of this rule will result in suspension or termination of your account, at our discretion.

6. When using Ourmedia, you must not violate any laws in your jurisdiction (including but not limited to copyright laws).

7. Because this site contains contributions from individuals, groups and cultures around the world with different standards and mores, Ourmedia follows the same policy as the Internet Archive: We err on the side of inclusion. Ourmedia may contain material deemed offensive, disturbing, pornographic, racist, sexist, bizarre, misleading, fraudulent, or otherwise objectionable. Ourmedia does not endorse any content uploaded to our site, nor can we guarantee that the material is accurate, complete, noninfringing or legally accessible in your jurisdiction. We have no obligation to remove objectionable content. Remember, folks, this most closely resembles an all-inclusive virtual library.

8. In general, Ourmedia is intended for personal use and is not a media hosting service for corporations. Certain business uses, such as by educators, professional photographers or filmmakers, are permitted. If in doubt, contact Ourmedia’s moderators.

9. The designated Ourmedia moderators shall be the sole arbiters of whether material shall be removed from this site.

10. You agree that any dispute between parties with regard to this Agreement or any provision herein shall, at the demand of either party, be promptly submitted to an arbitrator in the District of Columbia, in accordance with the rules relating thereto of the American Arbitration Association. Such arbitrator shall meet such qualifications as may be provided in such rules. The decision of the arbitrator shall be final and binding on the parties and may be enforced by any court of competent jurisdiction that the party prevailing in the arbitration may select, the other party hereby consenting and agreeing to submit to the jurisdiction over its person and venue in such court. Any costs or other expenses, including attorneys’ fees and costs incurred by the successful party, arising out of or occurring because of the arbitration proceedings, shall be assessed against the unsuccessful party.

Public education and nonpartisan nature

You understand that the main purpose of Ourmedia is for the advancement of public education and the furthering of free public access to cultural materials. The views expressed by our members are those of our members and not of Ourmedia, Outhink Media or our employees.

Consent to these provisions

Both Creators and Users agree that you have read the Site Rules in their entirety and consent to all its provisions. Violation of any of these terms may result in the termination of your Ourmedia membership.

Copyright Policy

Ourmedia obeys all U.S. laws. We respect the rights of content creators and their representatives. We will remove material from our site when we receive proper notice of alleged infringement that meets the requirements of federal law. Because this site allows individuals to upload materials without curator approval, some copyrighted material will inevitably find its way to our servers. Ourmedia cannot be responsible for the content posted by users on this site and in our network, but we will make a good faith effort to remove any such material as promptly as possible after proper notification.

Upon notification to Ourmedia of a claimed copyright infringement as described below, we will respond expeditiously to remove, or disable access to, the material that is claimed to be infringing or to be the subject of infringing activity pursuant to the following terms and conditions:

Notice of Claimed Infringement. All notices of claimed copyright infringement must be in writing and sent to Ourmedia's designated agent. The Notice of claimed infringement MUST contain the following pursuant to the Digital Millennium Copyright Act:

- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed (note: you may not act on someone else’s behalf without authorization).

- Identification of the copyrighted work claimed to have been infringed, or a list of multiple copyrighted works claimed to have been infringed; and

- Identification of the material that is claimed to be infringing and that is to be removed, and information reasonably sufficient to permit Ourmedia to locate the material, including the url(s) and the name or identity of the person whom you believe to be in violation;

- Information reasonably sufficient to permit Ourmedia to contact the complaining party, including name, address, telephone number and electronic mail address.

- A statement that the complaining party has a good faith belief that the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentations. Any person who knowingly materially misrepresents that material or an activity is infringing or that material or activity was removed or disabled by mistake or misidentification, shall be liable to Ourmedia for any damages, including costs and attorneys’ fee, incurred by Ourmedia in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

Termination of Subscriber’s Account. In the event a member or subscriber of Ourmedia uses or posts infringing material or conducts an infringing activity, and if Ourmedia has direct knowledge of said infringing material or activity, it is the policy of Ourmedia that it may terminate the infringing subscriber’s account so long as such termination does not interfere with “standard technical measures" as defined under the Digital Millennium Copyright Act.

In the event OurMedia receives proper notice, we will notify the Contributor that the work has been removed or blocked and provide an opportunity for proper counter-notification. If there is counter-notification, OurMedia will provide it to the copyright owner who sent the notice of infringement. If the copyright owner does not subsequently notify Ourmedia that it has filed a court action, Ourmedia will reinstate the material within 10 to 14 business days after receiving the counter-notification.

Under no circumstances, including, without limitation, negligence, shall Ourmedia or its affiliates, officers, employees or agents be responsible for any indirect, incidental, special, or consequential damages arising from or in connection with the use of or the inability to use the site, or any content contained on the site, or resulting from unauthorized access to the site, including, without limitation, damages for loss of profits, use, data or other intangibles, even if Ourmedia has been advised of the possibility of such damages.


Changes and Full Agreement

We expect to modify these Terms of Use as time goes on, and you understand and accept that fact. Whatever changes we make, however, will not alter the licensing choices that the member has made at the time of contributing his or her material.

This Agreement, the Privacy Policy, and other policies posted on the site constitute the full and complete agreement between you and Ourmedia and are not intended to inure to third-party beneficiaries.
